The Universidad Autónoma School of Law and Universidad Finis Terrae will host the 2nd Annual Review of Investment Arbitration Awards, which will be held on June 7 and 8 online. AUV partner and professor of International Law, Nicolás Vassallo, will present an important case regarding the concept of foreign investors’ legitimate expectations.

Prominent national and international arbitration leaders will participate, including legal experts from the Center for Arbitration and Conciliation of the Bogotá Chamber of Commerce, Heidelberg Center for Latin America, Florida International University, Universidad Católica Andrés Bello, and Universidad Autónoma.

On the first day participants will analyze rulings on jurisdiction, with a discussion on the future of dispute resolution mechanisms in investment matters, including key aspects such as modifications to the arbitration rules of specialized institutions, the dispute prevention clause of the Investment Cooperation and Facilitation Agreements, and the creation and incorporation of the Investment Court in investment treaties.

On the second day, the rulings on merits will be addressed, with the discussion of interesting international cases of companies vs. countries including Italy, Latvia and Spain.

Nicolás Vassallo will present on the second day on the case ESPF Beteiligungs GmbH, ESPF Nr. 2 Austria Beteiligungs GmbH, and InfraClass Energie 5 GmbH & Co. KG v. Republic of Italy, ICSID, Case No. ARB / 16/5, arbitration award dated 09/14/2020. “This case is relevant, because it is part of the saga of renewable energy cases in Europe which deeply addresses the concept of legitimate expectations of foreign investors, shedding light on the concept of regulatory modifications,” the AUV Partner said.
